Terms and Conditions

Parties:

Blue Chip Vacations Ltd, the “Agents”, act only as Agents for the owners of the property, “the Owners”. Clients applying to book a property are referred to as “The Tenants.” The names of all those who will be occupying the property during the period of booking must be specified on the “Booking Form”. Any contract is between the Tenants and the Owners, who are responsible for providing the property to the Tenant in the appropriate condition. The names and addresses of the Owners can be provided on request. The Agents act only as agents for the Owners and are not Principals.

Payments:

If a booking is made six weeks or more before the tenancy is due to start it must be accompanied by a deposit of one third of the rent plus a non-refundable booking fee. If a booking is made less than six weeks before the start of the holiday, the full rent plus a non-refundable booking fee must be paid at the time of booking. Once the booking is accepted in writing by the Agents, the Tenants are liable for balance of the payment of rent, plus any additional charges, six weeks before the start of the tenancy. The deposit is non-refundable. All prices quoted include VAT and Insurance Premium Tax where applicable at current rates. Any changes in the rate will be adjusted on arrival. Payment may be made by cheque, postal order, debit or credit card or cash by registered post. Any charges raised against the Agents by their bank for handling any form of payment, or charges for dishonoured cheques, or charges for overseas transfers, will be passed onto the Tenants who are liable to reimburse the Agents within 7 days of notification of same. Credit Card Transactions are liable to a 2.0% charge (not Debit cards).

Amendments:

Alterations to confirmed bookings will be subject to a £25 administration charge.

Cancellation:

If cancellation of booking is made six weeks or more before the tenancy is due to start, the balance will not be charged. If cancellation is made less than six weeks before the start of the holiday, the balance is payable in full. The cost of this booking includes the Cancellation Protection Scheme charge (copy of terms below).

Arrival & Departure Times:

Bookings commence at 3.00pm, unless otherwise notified, on the first day of your holiday and end at 10.00am on the day of departure.

Pets:

The majority of our properties are not suitable for pets, but they are allowed in some properties by prior arrangement, subject to payment of the appropriate fee. Dogs must be well behaved and kept under control at all times, are not allowed in bedrooms and must not be left unaccompanied in the property. Any excess cleaning over and above the additional fee will be invoiced to you as per "Condition of Property / Inventory".

Linen:

Bed Linen is included in the price, and beds will be made up on arrival. Towels (not beach towels) are included in most properties. Sofa beds where requested will not be made up but linen will be provided.

Fuel costs:

All gas and electricity costs are included in the booking price.

Smoking:

All of our properties are non-smoking. 

Parking:

Specific parking instructions for the applicable property will be issued and must be adhered to. Any vehicle and contents are parked entirely at your risk.

Condition of Property / Inventory:

Before you arrive your property will have been cleaned and the inventory checked. Discrepancies should be reported within 24 hours of arrival to the Agents, the inventory will otherwise be deemed to be correct. Losses, damage or any cleaning necessary over and above normal servicing, will be invoiced to you on departure. By accepting our terms and conditions you authorise us to deduct payment for these from your credit card or debit card.

Brochure Descriptions:

The Agents reserve the right to amend prices quoted in the brochure, due to errors or omissions, or changes in fuel rates. Photographs of the interiors of properties are representative only and interiors may vary. Changes to external premises or facilities described in the brochure or changes to availability of properties are outside of our control and cannot be relied upon absolutely. The Agents and Owners take no responsibility for noise or nuisance resulting from third party activity over which they have no control.

Character Properties:

Many properties are older properties which can be subject to damp, spiders, insects etc. No guarantee can be offered against such eventualities nor any liability accepted. The Tenants are responsible for confirming whether a property is an older property prior to booking.

Damage to Property:

The Tenant is liable for the full cost of any damage caused to or within the property during the letting. By accepting these terms and conditions you agree to us taking payment for any damages from your credit or debit card.

The Tenancy:

The Tenancy confers upon the Tenants the right to occupy for a holiday within the meaning of schedule 1, Paragraph 9 of the Housing Act 1988. The Tenants agree: (a) To pay for any losses or damage to the property however caused (reasonable wear and tear excepted). (b) To take good care of the property and leave it in a clean and tidy condition at the end of the tenancy. (c) To permit the Owners and Agents reasonable access to the property. (d) Not to part with possession of the property or share it except with members of the party as shown on the booking form. In no circumstances may the number of people exceed the stipulated description. A cot may only be occupied by a child aged 24 months or less. (e) Not to cause an annoyance or become a nuisance to occupants of adjoining premises. (f) Not to use the property for any commercial purposes. In the event of breach of these terms and conditions the Tenants may be required to leave the property during the period of the booking.

Size & Party:

Unless expressly agreed in advance by the Agents, no group bookings (four or more adult party members) are accepted where all party members are under 25 years of age. Unless expressly agreed in advance by the Agents, no group bookings are accepted where all members are of the same sex, unless the group consists of members of the same family across a number of generations. The Owners and Agents reserve the right to refuse access to the property without compensation where no agreement has been given in advance. The Tenants right to occupy the property may be forfeited without compensation, or an additional charged levied, if: (a) more people or guests than specified on the Booking Form and/or the number the Property holds, attempt to take up occupation; (b) Overnight guests are entertained without the Owner’s express permission; (c) Any activity is undertaken which may cause unreasonable damage, noise or disturbance.

Liability:

The Agents do not accept liability for any act, neglect or default on the part of the Owners or any other person not within their employ, nor for any accident, damage, loss, injury, expense or inconvenience whether to person or property, which the Tenants or any one connected with the letting may incur. We reserve the right to provide alternative accommodations or cancel owing to unforeseen circumstances beyond our control. If for any reason beyond the Owner’s control the property is not available on the date booked (owing to fire damage for example) or the property is unsuitable for holiday letting, all rent and charges paid in advance by the Tenants will be refunded in full, but the Tenants shall have no further claim against the Owners or Agents.

Disclaimer:

All properties are used at your own risk. Special care must be taken by Tenants at properties where there is a swimming pool, balcony or elevated terrace which are used at your own risk. Parents should ensure that their children are supervised in such areas at all times.

Authority to Sign:

The person who signs the booking form certifies that he or she is authorised to agree the Terms and Conditions on behalf of all persons included on the booking form, including those substituted or included at a later date. He or she agrees to take responsibility for the party occupying the property.

Governing Law & Jurisdiction:

The contract is deemed to have been made at P.O. Box 68, Brixham, Devon. The validity, construction and performance of this Agreement shall be governed by English Law. The Tenants submit to the exclusive jurisdiction of the English Courts.

Complaints:

All complaints must be notified to the Owner or their designated property manager immediately to ensure sufficient time is given to investigate and/or take the necessary remedial action. Compensation will not be offered where the Tenants have denied the Agents or the Owners the opportunity to rectify matters during holiday. The Agents will act on a goodwill basis as arbitrators between the Tenants and the Owners.

Cancellation Protection Scheme - Terms and Conditions

Blue Chip Vacations provide a cancellation protection scheme for all guests booking a stay in a Blue Chip Vacations property. This provides a full refund of monies paid for the deposit or the full cost of the holiday, less a £25 administration charge, the full charge for the Cancellation Protection Scheme and any credit card charges, in the event of an unavoidable cancellation for the reasons covered below. The following terms & conditions set out the cancellation protection scheme in full.

Cover

  • Serious injury, illness, quarantine or death of any member of the travelling party listed on the booking form at the time of booking.
  • Serious injury, illness or death of a close relative: specifically a parent, brother, sister, daughter, son, fiancé, fiancée or close business associate of any member of the travelling party listed on the booking form at the time of booking.
  • Any member of the travelling party listed on the booking form at the time of booking being summoned for jury duty or as a witness in a court of law over the period upon which the holiday occurs.
  • Any member of the travelling party listed on the booking form at the time of booking being made redundant from their place of work, where redundancy takes effect before or during the booked holiday dates.
  • Any member of the travelling party listed on the booking form at the time of booking having their home rendered uninhabitable by fire, storm or flood.

Exclusions

The following specific exclusions apply and are not covered by the scheme:

  • Serious illness, injury or death of a party member caused by a condition known to that party member at the time of booking.
  • Cancellation due to the pregnancy of any member of the travelling party.
  • Injury, illness or death of any member of the party due to (attempted) suicide or the mis-use of intoxicating substances or non-prescription drugs.
  • Cancellation due to any member of the party being dismissed from their place of employment.
  • Cancellations where the affected individual is aged 75 and over at the time of booking or claim.
  • Cancellations due to redundancy where the redundancy takes effect after the date of arrival.
  • Illness or injury to any member of the party deemed not serious enough to prevent travel.

Conditions

  • If a booking is cancelled due to a medical condition or any other reason known to the claimant at the time the cancellation protection is paid for, any subsequent claims will be invalid.
  • The scheme covers a full refund only and not a part refund. If the holiday ends prematurely after arrival for any reason, no refund is payable.
  • If, within six weeks of arrival, the holiday is cancelled for a reason not covered above, the full balance is still payable by the guest, as per the normal booking terms & conditions.
  • The scheme will provide a refund of sums paid only for the situations listed in ‘COVER’ above.
  • Where cover is also provided under an insurance policy separately negotiated by the Tenants, such policy shall be deemed to take precedence and no refund will be paid under the Cancellation Protection Scheme.

Period of Cover

The scheme begins upon the date of booking and ends at midday on the day when the stay commences.

Claims

  • In the event of a cancellation and subsequent claim, Blue Chip Vacations must be informed within 1 week of the event which causes the cancellation. If the stay is due to begin within one month, notification by email or phone (01803 855282) must take place within 48 hours of the event occurring.
  • All claims must be submitted in writing along with documentary evidence of the cause of the cancellation (such a doctor’s note, a death certificate or a Department of Employment letter). The cost of producing any such evidence must be borne by the claimant.
  • All claims must be submitted to Claims Department, Blue Chip Vacations, PO Box 68, Brixham, Devon, TQ5 9WZ, Fax. 01803 881029, Tel. 01803 855282.
  • Blue Chip Vacations reserve the right to pay for any further medical examinations or an autopsy when investigating a claim.
  • Blue Chip Vacations reserve the right to report fraudulent claims to the police.
